- This is a binding contract between "Buyer" of animal and Class Act
Kennel being hereby known as "Seller" and is fully enforceable
upon submission of full payment for animal and shipping fees if
applicable and accepted payment by Seller. Seller does not
guarantee the breeding capability of animal now or in the future.
Seller does not guarantee weight, size, quality or temperament of
animal. Puppy is sold 'as is' in regards to conformation and/or
breed faults.
- Seller does not guarantee against bad bites or hernias. Seller
furthermore does not guarantee against stress related conditions such
as, but not limited to, Giardia, Coccidiosis and Hypoglycemia.
- Seller will guarantee the animal for 72 hours toward a well puppy
check-up against death related untreatable conditions that would warrant
the immediate humane euthanization of animal that existed prior to the
animal being placed with buyer. Buyers veterinarian must attest to
condition in writing to validate the guarantee. Seller reserves
the right to have seller's vet recheck the puppy and go with seller vets
diagnosis. The BUYER will agrees to a replacement animal,
when one becomes
available, in the case of such an unforeseen incident at sellers sole
discretion. No transportation or medical fees will be refunded
under any circumstance. In the unforeseen case of replacement,
buyer is responsible for the transportation fees. Puppy must be
under the care of a licensed Veterinarian in order for BUYER to enact
guarantee.
- Seller is not responsible for medical treatment, medical fees of any
kind, upkeep of animal, training of animal, nor mental stress to
buyer. Seller does not guarantee against Parvo, Distemper, Kennel
Cough or Canine Flu and
buyer is aware that both are highly contagious and can be contracted
within seconds of receiving the animal. It is the buyers
responsibility to keep said animal out of contact with such
viruses. Seller strongly recommends that animal be kept out of
public or contaminated areas until animal has been vaccinated with ALL
veterinarian recommended vaccinations.
- Buyer agrees to be a responsible pet owner, finish animals
vaccinations in a timely manner and maintain dog throughout it's life in
an appropriate atmosphere. Buyer furthermore agrees to have or
properly train the animal so that it is considered a good companion by
all that come in contact with it. Buyer additionally agrees to
feed the animal a good quality food throughout it's lifetime.
- Seller relinquishes full responsibility of animal upon releasing
animal to the buyer. Buyer takes full responsibility both
physically and monetarily upon taking possession of animal.
- Seller has provided Buyer with a shot/wormer record and the BYA/ACR Puppy Papers. Buyer is responsible for the registration and
fees to register animal.
- Seller will take back animal at any time and re-home it if the need
arises. Buyer is responsible for the cost of getting the animal
back into the Sellers possession. Seller at no time will pay Buyer
for taking the dog back or for re-homing it. Seller is not
responsible for issues that arise once puppy is purchased such as but
not limited to issues involving landlord, spouse, live-in, children,
financial, medical or city/state/federal ordinances.
- Buyer has agreed to the above conditions upon remitting the monies
for animal.
- This contract is a legal and binding contract executed in the State
of Arkansas, County of Miller.
- Any legal actions must be done in Miller County, State of Arkansas
and buyer agrees to pay both parties legal fees if the need arises.
